Palm Springs San Diego Orange County California Food Poisoning Attorney Sebastian Gibson Discusses the New Country of Origin Labelling Act (cool)
Until now, consumers who suffered food poisoning and investigators seeking the cause, had no idea what country food that was eaten came from. With the new COOL (Country of Origin Labeling) law taking effect after September 30, 2008, everything will change, with some exceptions.
Now, when you get food poisoning, whether the food you buy at the store San Diego, California, Orange County, California, Los Angeles, Santa Barbara, Anaheim, Buena Park, Palm Springs, Temecula, Indian Wells, La Quinta or restaurant Ventura, Carlsbad, Oceanside, San Clemente, San Juan Capistrano, Newport Beach, Huntington Beach, Irvine, Santa Ana, Costa Mesa, Yorba Linda, Fullerton, Ontario, Rancho Cucamonga, Riverside, San Bernardino, Temecula, Palm Desert or, when the Department of Health investigation into what made you sick, they may be able to determine more accurately and without causing serious economic consequences for agricultural interests not at fault.
After years of lobbying for delays by grocery lobbyists who argued the law would be too costly to implement, and lobbied for delays, has finally COOL took effect.
Now, investigators will find it easier to track the country of origin. As has often been raw foods, such as peppers from Mexico, more recently, the effect of the law will immediately help the investigators. The health-conscious consumers can feel more loyalty to a retailer who does not comply with the law reluctantly, but that touts their course or an extra step two to let their customers know exactly what comes from where.
Other food poisoning in recent years have involved the spinach, and beef. Now, with the fear of milk from China, there are calls to extend the right to dairy products.
There also exceptions in COOL for butchers, fish markets, restaurants, restaurants in hotels, school cafeterias, and small retailers. In addition, if the spices, sauce or breading has been added, no labeling is required. Though not exactly food, the law does not apply to pharmaceuticals, but there are calls to extend the right for them. Producing mixed views can simply be labeled as "two or more countries of origin."
Legislators and consumer groups are angry that the USDA appears be attempting to evade the intent of Congress by allowing steaks and other cuts of meat should be labeled with multiple labels country of origin. Congress does that except for a ground meat for animals raised in several countries. It has been said that there a gulf of difference between the wording of the law that was passed by Congress and the rule which allows multiple countries of origin labels prepared by the USDA.
There are other differences in how the law will be applied. The fish caught off the coast of Alaska by a Chinese or Japanese owned ship may be labeled as a product of China or Japan. Butcher raised in another country that spends 30 days in a feedlot in the United States can be labeled as being from the United States
Retailers have the discretion how they label the food. meat counters, for example, may simply be a list of all countries where meat is produced, or they can label each cut. Hamburger still likely to reflect the consumers that the meat is ground up may come from many countries.
Once entered into force compliance, companies can be fined $ 1,000 per violation. The law should cost at least $ 2 billion to develop work.
